Landlord Boiler Responsibilities: What You Need to Know

As a landlord in England and Wales, you have specific legal responsibilities regarding the gas appliances in your rental properties, including boilers. Failure to meet these obligations can result in prosecution, unlimited fines and even imprisonment. This guide outlines everything you need to know about your boiler-related responsibilities as a landlord.

Annual Gas Safety Check

Under the Gas Safety (Installation and Use) Regulations 1998, landlords are legally required to have all gas appliances, fittings and flues in their rental properties checked annually by a Gas Safe registered engineer. This includes boilers, gas fires, gas cookers and any other gas appliances provided as part of the tenancy.

The gas safety check must be carried out within 12 months of the previous check. You must keep a record of each safety check for at least two years and provide a copy of the gas safety certificate to existing tenants within 28 days of the check, and to new tenants before they move in.

Maintaining the Boiler

Beyond the annual gas safety check, landlords have a general duty to keep the boiler and heating system in good working order. This means:

  • Responding promptly to reports of boiler faults or breakdowns
  • Arranging repairs by a Gas Safe registered engineer
  • Ensuring the boiler is serviced annually (separate from the gas safety check)
  • Replacing the boiler when it can no longer be safely or economically repaired

Providing Adequate Heating

Under the Landlord and Tenant Act 1985, landlords must ensure that rental properties are fit for human habitation. This includes providing adequate means of heating. The property must be capable of being heated to a reasonable temperature, which is generally accepted as at least 18 degrees Celsius in living rooms and 21 degrees Celsius in bedrooms when the outside temperature is minus 1 degrees Celsius.

If a boiler breaks down during winter and cannot be repaired promptly, the landlord may need to provide temporary heating such as electric heaters until the boiler is fixed or replaced.

Energy Performance Certificate (EPC)

Since April 2020, rental properties in England and Wales must have a minimum EPC rating of E. An old, inefficient boiler can significantly affect your property's EPC rating. Upgrading to a new A-rated boiler can improve the EPC rating and ensure compliance with the Minimum Energy Efficiency Standards (MEES).

Tenant's Responsibilities

While the landlord is responsible for maintaining the boiler, tenants also have responsibilities:

  • Reporting boiler problems promptly
  • Allowing access for annual gas safety checks and maintenance
  • Not tampering with the boiler or gas supply
  • Using the boiler in accordance with the manufacturer's instructions

Penalties for Non-Compliance

The consequences of failing to meet your gas safety obligations are severe:

  • Criminal prosecution: Failing to carry out an annual gas safety check is a criminal offence.
  • Unlimited fines: There is no cap on the fines that can be imposed.
  • Imprisonment: In the most serious cases, landlords can face up to six months in prison.
  • Civil liability: If a tenant is injured or killed as a result of a gas safety failure, the landlord can face civil claims for damages.
  • Insurance implications: Landlord insurance policies may be invalidated if gas safety requirements have not been met.
